William J. Fisher

William J. Fisher has been able to obtain successful resolution of disputes both by negotiation and by litigation. For example, he was involved in negotiating the stipulated dismissal of a declaratory judgment action based on allegations of patent invalidity and antitrust violations against a client, thus affording the client the additional opportunity to institute a licensing program. Additionally, Mr. Fisher was involved in a lawsuit which yielded a payment to the firm’s client in excess of $6 million after judgment, and in the briefing of the appeal, in which the judgment was affirmed. Mr. Fisher also has successfully negotiated with potential adversaries and avoided involving the firm’s clients in threatened litigation.
Mr. Fisher makes client counseling, opinion preparation, and obtaining and retaining patent protection the main focus of his practice. He has advised clients with regard to interference prosecution, resulting in denial of the grant of the adversary’s patent application, and denial of a request for reexamination of our client’s patent based on prior art asserted by the client’s licensee as invalidating the patent. He also oversees the preparation and prosecution of patent applications.
Technologically, Mr. Fisher’s practice is concentrated in the chemical arts, including both organic and inorganic chemistry, petrochemical processing, chemical processing and plant control, catalysis, metallurgy, and food chemistry and preparation. He has experience in adhesives, including adhesives with organic components, for laminated products, chipboard, and oriented strand board and other structural composites; paper production and size for paper products; and security papers. Other work has involved design and operation of machines in cloth-cutting and sign-making technologies.
Prior to joining Plumsea, Mr. Fisher practiced for over two decades with Banner & Witcoff. Prior to entering the legal field, Mr. Fisher was employed for eight years by ExxonMobil, the world’s largest refiner and marketer of petroleum products. While at ExxonMobil, his primary responsibilities related to innovation, engineering, and design of fixed bed catalytic reforming, desulfurization, and fluid catalytic cracking units.
Mr. Fisher is active in various bar associations, and his court admissions include the U.S. Supreme Court, the U.S. District Court for the District of Columbia and the U.S. Court of Appeals for the Federal Circuit.
